DUI Related Vehicle Forfeiture

Orlando DUI Defense Attorney - Lawyer, providing experienced DUI Defense and other Criminal Defense legal Services in Orlando, Orange County, and Central Florida areas.

When an individual is arrested for a DUI offense, the last thing they would think that they may have to deal with is the forfeiture of their vehicle. Impounded... maybe. but not Vehicle Forfeiture.

If your DUI arrest is not your first, and you have a prior DUI conviction on your

Florida Statute Section 322.34(9)(a) provides:

Your vehicle is subject to seizure and forfeiture regarding a DUI if two conditions are met:

  1. You are arrested for a DUI after January 1st, 2000; and

  2. If at the time of your arrest, your privilege to drive is already under suspension, cancellation, or revocation as a result of a prior DUI conviction.

The DUI Vehicle forfeiture may be considered a civil forfeiture which only requires a "preponderance of the evidence" to be proven in order to achieve a vehicle forfeiture verdict. This means it is possible for an individual to be found "not guilty" in the DUI case, and still be subject to vehicle forfeiture in the Civil Forfeiture case.

Having experienced representation in both legal matters is extremely important not only for your freedom, but your driving privileges and avoiding vehicle forfeiture as well.

Being charged with a DUI Offense does not always mean a conviction will follow. Your best chance to have a successful outcome in any DUI related legal situation is to seek the legal advice and representation of experienced legal counsel.

If you require professional legal services regarding DUI defense or other criminal defense issues, be proactive in protecting your legal rights by seeking the legal advice of an experienced Orlando DUI defense attorney & lawyer.
