DUI Arrest While Driving with a Suspended License

Orlando DUI Defense Attorney - Lawyer, providing experienced DUI Defense and other Criminal Defense legal Services in Orlando, Orange County, and Central Florida areas.

Most people associate a DUI with drinking and driving. Florida DUI Statutes also involve driving while under the influence of illegal drugs, prescription drugs, or any other substance which may impair your ability to safely operate a motor vehicle, or other mode of transportation.

While the methods for proving a drug related DUI in court may be different than that of a drinking and driving charge, some of the same indicators and roadside tests are often used to determine if you are impaired, leading to your arrest.

If law enforcement on the scene has determined that they have probable cause, they will most likely choose conduct a search of your vehicle. If drugs, open alcohol containers, or other substances which may cause impairment are found in your vehicle, the evidence may be used against you to support the arrest for a drug related DUI and/or other criminal charges.

When law enforcement assess if one is impaired by drugs or alcohol it is a subjective process which may be challenged in any DUI criminal case. This includes any actions, questions, roadside sobriety tests, or other processes which law enforcement used which lead them to believe you were impaired. Without probable cause, anything found on your person or in your vehicle may be rendered inadmissible in your trial.

It is not uncommon for law enforcement to use the excuse of impairment to give them probable cause to search your vehicle. Many times when this happens, the accused is not given a breathalyzer test or blood test. The attorney you are assigned or that you hire to represent your rights may have a direct impact on your ability to achieve a successful outcome. When it comes to your rights and freedoms… EXPERIENCE COUNTS.

Finding out what your options may be and if you possess legal standing to have the charges dropped or reduced is an important step you should take when your future may be adversely affected by simply accepting a plea, or if convicted of a drug crime.
